1. IntroductionWelcome to SHRIHARI SUPER MARKET.These Terms & Conditions govern your access to and use of the services, products, communications, website, digital platforms, customer-support channels and messaging facilities made available by SHRIHARI SUPER MARKET (“SHRIHARI SUPER MARKET”, “we”, “us”, or “our”).SHRIHARI SUPER MARKET is a proprietorship business engaged in supermarket and retail activities, including the sale and supply of groceries, household products, packaged consumer goods, daily-use products and other products that may be offered by the business from time to time.These Terms are intended to establish clear expectations between SHRIHARI SUPER MARKET and its customers, website visitors, subscribers and other users. They also apply where applicable to customer communications conducted through WhatsApp Business, WhatsApp Business Platform, RCS or other approved digital communication channels.By accessing our website, contacting us digitally, submitting information to us, placing an order where such facility is available, subscribing to communications, or otherwise interacting with SHRIHARI SUPER MARKET, you acknowledge that you have read and understood these Terms and agree to be bound by them to the extent applicable.Where a particular service has additional terms, those additional terms will apply together with these Terms.

2. DefinitionsFor purposes of these Terms:“Business” means SHRIHARI SUPER MARKET, a proprietorship operating from Yeola, Nashik, Maharashtra.“Customer”, “User”, “you”, or “your” means any person who visits, contacts, purchases from, communicates with, or otherwise interacts with SHRIHARI SUPER MARKET.“Website” means any website, landing page, web property or digital interface operated by or for SHRIHARI SUPER MARKET.“Services” means the retail, customer-support, order-related, promotional, informational and digital communication services provided by SHRIHARI SUPER MARKET.“Products” means groceries, packaged foods, household goods, personal-use products, daily necessities and other merchandise offered by SHRIHARI SUPER MARKET.“WhatsApp Services” means WhatsApp Business or applicable WhatsApp Business Platform facilities used by SHRIHARI SUPER MARKET for customer communication.“RCS” means Rich Communication Services and related business messaging functionality made available through applicable Google, carrier, telecom or technology infrastructure.“Message” means any communication sent or received through WhatsApp, RCS, SMS, email, website forms or other communication channels.“Personal Data” means information relating to an identifiable individual, as applicable under Indian data-protection law.

3. Acceptance of TermsBy using the services of SHRIHARI SUPER MARKET, you agree to these Terms.If you do not agree with these Terms, you should discontinue use of the applicable website, digital service or communication channel.Where you use our services on behalf of another person, you confirm that you have the authority to do so.For customers placing purchases or requesting customer assistance, acceptance may also occur through conduct, including placing an order, providing contact details for fulfilment, requesting a receipt or voluntarily initiating communication with the Business.Certain transactions may be subject to additional terms displayed at the point of purchase.

4. Description of ServicesSHRIHARI SUPER MARKET provides supermarket and retail services to customers in accordance with the products and facilities available at the relevant time.Our services may include:Sale of grocery and supermarket products;Sale of packaged consumer products;Household and daily-use products;Customer support and enquiries;Product availability information;Order-related communications where applicable;Promotional announcements where the customer has provided appropriate consent;WhatsApp-based customer communication;RCS-based business messaging where enabled;Digital receipts, notifications or transaction-related messages; andOther retail-related services introduced by SHRIHARI SUPER MARKET.Product availability, prices, offers, stock quantities, delivery arrangements and service availability may change without prior notice, subject to applicable law.Where an online or messaging-based order facility is offered, acceptance of an order by the Business may be subject to product availability, pricing verification, delivery/service-area availability and other applicable conditions.

5. EligibilityCustomers must provide accurate information when information is required to provide a service.Where a customer is below the applicable legal age for independently entering into a particular transaction, the transaction should be undertaken with the involvement or authorization of a parent, guardian or other legally authorized adult where required by law.SHRIHARI SUPER MARKET does not intentionally design its services to solicit unnecessary personal information from children.The Business reserves the right to refuse or discontinue a transaction where required by law, platform policy, fraud-prevention requirements or legitimate business requirements.

6. Account RegistrationIf SHRIHARI SUPER MARKET introduces customer accounts, loyalty accounts, digital ordering accounts or similar facilities, customers may be required to provide information such as their name, mobile number, email address or other information reasonably necessary for the service.Customers are responsible for ensuring that information provided to the Business is accurate and current.Where an account involves credentials, customers must keep those credentials confidential and must notify the Business if unauthorized use is suspected.SHRIHARI SUPER MARKET will not knowingly ask customers to disclose passwords, authentication codes or other confidential security credentials through unsolicited messages.

7. User ResponsibilitiesUsers agree to:Provide truthful and accurate information;Use the Business’s digital services only for lawful purposes;Avoid submitting malicious code, spam or harmful content;Avoid impersonating another person or organization;Avoid attempting unauthorized access to Business systems;Respect the rights and privacy of other customers;Avoid using Business communication channels to distribute illegal or harmful material;Provide only information reasonably necessary for the requested service;Follow applicable platform rules when communicating through WhatsApp or RCS; andRespect reasonable instructions relating to customer support, ordering and communication preferences.Customers must not use our messaging channels to send fraudulent requests, phishing links, malware, deceptive material or communications designed to interfere with our systems.

8. Payment & Billing TermsWhere products or services are purchased, the applicable price will be the price communicated or displayed at the relevant point of sale, subject to correction of genuine pricing or technical errors and applicable law.Customers are responsible for paying the applicable purchase price, taxes, delivery charges or other disclosed charges associated with their transaction.Payment methods may include cash, card, UPI, bank-based payment methods, digital payment facilities or other methods accepted by SHRIHARI SUPER MARKET.Where third-party payment providers are used, payment processing may be governed by the third party’s terms and privacy practices.SHRIHARI SUPER MARKET does not intentionally request customers to provide complete payment-card information through WhatsApp or ordinary customer-support messages.Receipts, invoices and transaction records may be maintained where required for accounting, taxation, legal compliance, customer service or dispute-resolution purposes.

9. Subscription Renewal & TerminationSHRIHARI SUPER MARKET may introduce optional subscription, membership, loyalty, promotional or recurring services in the future.Where a subscription or membership is offered, the applicable price, billing cycle, renewal mechanism, cancellation procedure and applicable benefits will be disclosed before or at the time of enrollment.Unless specifically stated otherwise, customers will not be considered enrolled in a paid recurring subscription merely because they provide their mobile number or communicate with SHRIHARI SUPER MARKET.Where recurring billing is applicable, renewal will occur according to the terms communicated at enrollment and applicable payment-provider requirements.A customer may request cancellation in accordance with the applicable subscription terms.SHRIHARI SUPER MARKET may suspend or terminate an account or subscription where there is fraud, misuse, non-payment, violation of these Terms, legal requirement or a material security concern.Termination does not automatically extinguish obligations that by their nature are intended to survive termination, including payment obligations, intellectual-property provisions, confidentiality provisions, limitation of liability and dispute-related provisions.

10. Use of WhatsApp Official API & RCSSHRIHARI SUPER MARKET may use WhatsApp Business, WhatsApp Business Platform, WhatsApp Cloud API or approved service-provider infrastructure to communicate with customers.Such communications may include:Order confirmations;Product or service enquiries;Customer-support messages;Transactional notifications;Store-related announcements;Offers and promotional information where appropriate consent has been obtained;Feedback requests; andOther legitimate customer communications.SHRIHARI SUPER MARKET will seek to maintain accurate business identification and contact information when using business messaging platforms.WhatsApp’s Business Messaging Policy requires businesses to have appropriate permission before initiating WhatsApp communications and to respect requests to block, stop or opt out of communications.Accordingly, SHRIHARI SUPER MARKET will not intentionally use WhatsApp messaging facilities to send unsolicited communications in violation of applicable law or platform requirements.RCS communications, where enabled, will be subject to the applicable Google RCS for Business Terms of Service, Acceptable Use Policy, carrier requirements and other applicable platform policies. Google’s current RCS policies require accurate business information and appropriate consent for relevant data uses and messaging.Customers acknowledge that third-party platforms may independently modify, restrict, suspend or discontinue their services. SHRIHARI SUPER MARKET does not control WhatsApp, Meta, Google, mobile network operators or third-party messaging infrastructure.

11. Message Delivery & Compliance PolicySHRIHARI SUPER MARKET seeks to ensure that customer communications are relevant, lawful, transparent and consistent with applicable messaging policies.Messages may be delayed, filtered, rejected or undelivered because of:Mobile network problems;Internet connectivity;Customer device settings;Carrier restrictions;WhatsApp or RCS platform restrictions;Incorrect contact information;Spam filtering;Technical outages;Template approval or platform requirements; orOther circumstances outside the reasonable control of the Business.SHRIHARI SUPER MARKET does not guarantee that every WhatsApp or RCS message will be delivered, read or responded to.Where a messaging platform requires an opt-out mechanism, SHRIHARI SUPER MARKET will respect valid opt-out requests within the applicable operational and legal requirements.Customers should not rely exclusively on electronic messaging for emergencies, urgent matters or circumstances requiring immediate physical confirmation.

12. Intellectual Property RightsUnless otherwise stated, the name SHRIHARI SUPER MARKET, business branding, logos, website materials, original text, graphics and other proprietary materials used by the Business are owned by or lawfully used by SHRIHARI SUPER MARKET.Customers may use website content for personal and lawful purposes.No customer may reproduce, modify, distribute, commercially exploit, reverse engineer or publicly republish proprietary Business content without appropriate authorization, except where such use is permitted under applicable law.Third-party trademarks, product names and logos remain the property of their respective owners.Nothing in these Terms transfers ownership of intellectual-property rights from SHRIHARI SUPER MARKET to a customer.

13. ConfidentialityWhere a customer voluntarily provides confidential information in connection with a legitimate transaction or service request, SHRIHARI SUPER MARKET will handle that information according to applicable law and its Privacy Policy.Customers should not send confidential credentials, passwords, complete payment-card numbers, authentication codes or other highly sensitive information through ordinary messaging channels unless a specifically authorized secure process is provided.The Business may disclose information where required by law, court order, government authority, fraud-prevention requirement or legitimate legal process.

14. Disclaimer of WarrantiesTo the extent permitted by applicable law, digital services and website information are provided on an “as available” basis.SHRIHARI SUPER MARKET seeks to maintain accurate product and business information but does not warrant that every website page, product listing, price, communication channel or digital feature will always be uninterrupted, error-free or continuously available.Product descriptions and availability may change.Nothing in these Terms excludes warranties or consumer rights that cannot lawfully be excluded under applicable Indian law.

15. Limitation of LiabilityTo the maximum extent permitted by applicable law, SHRIHARI SUPER MARKET will not be liable for indirect, incidental, consequential or special losses arising solely from temporary unavailability of third-party communication services, internet infrastructure or circumstances outside the Business’s reasonable control.The Business remains responsible for obligations that cannot legally be excluded or limited.Nothing in these Terms is intended to exclude liability for fraud, deliberate misconduct or any other liability that cannot lawfully be excluded under Indian law.Where a specific service has separate statutory consumer protections, those protections will continue to apply.

16. IndemnificationTo the extent permitted by applicable law, a customer may be responsible for losses, claims or reasonable expenses arising from the customer’s unlawful use of SHRIHARI SUPER MARKET’s website, communication systems or services, fraudulent activity, intentional misuse, infringement of third-party rights or violation of these Terms.This provision does not require a customer to indemnify SHRIHARI SUPER MARKET for losses caused by the Business’s own unlawful conduct.

17. Governing Law (India)These Terms are governed by the laws applicable in India.Subject to mandatory consumer-protection and other statutory jurisdiction requirements, disputes arising from these Terms or the services of SHRIHARI SUPER MARKET shall be subject to the jurisdiction of the competent courts having jurisdiction over the Business’s place of operation in Maharashtra.Nothing in this section prevents a customer from exercising any mandatory statutory right or remedy available under applicable Indian law.

18. Changes to TermsSHRIHARI SUPER MARKET may update these Terms from time to time to reflect changes in its services, business practices, technology, legal requirements or messaging-platform requirements.The updated version will be published on the applicable website or made available through another reasonable communication method.Where a change materially affects customer rights or obligations, the Business will take reasonable steps to provide appropriate notice where required.Continued use of applicable services after an updated version becomes effective may constitute acceptance to the extent permitted by law.
